My spouse works at a bay area company and we have noticed that the perm salary is little higher than actual salary(15%).. does anyone observe it in their scenario ? Is this anomaly or any reason ? Share your experience
Aah ok.. PERM is green card application.. hiring companies have to put a salary in it.. and it is higher than actual salary at the moment
They generally do to avoid another PERM for raise.
Did not follow.. why do they have to another PERm if salary increases?
There is a step called prevailing wage determination during Perm. So, at any point if the person starts to earn more it can cause I-140 application into audit. So, to be safe employers to do file for the max salary of that position/level.
Don't remember the details - what does the clause actually say? "Actual salary of this person"? Or something like "min salary" or "max salary" or "Average" for someone in that position?
From what I understand, PERM is the minimum salary for a sponsored employee with a green card. They are obligated to pay the offered salary or the PERM salary (whichever is higher). I think there are exceptions if the company is unable to pay. PERM salary is only for green card holders, so if she is still waiting on that; they can pay her less.
I have exactly the same situation right now. PW is filed for position, and not for person. So that’s ok, but They will have to increase your salary before i-485 approval.
There is no one common PERM salary number.. they(company and its attorneys) have lot of knobs to play around with the perm salary level. There are 4 defined skill levels and a default lowest level (that makes it 5 levels) to determine the perm wages..
It is a common situation to be in esp in second/third grade companies like Oracle. I am not sure where your wife works. This happens because, perm salaries are taken from that year limits, but your wifes salary would have been from an lca that is filed last year/year before. She ll get a correction when she gets her H1 renewed next. If she is on L1. Good Luck!
Not only my Spouse's PERM, i heard couple of other friends from different companies had similar PERM to sal difference..
Yeah but eventually you get tired of getting perms when you get your hair did so just a regular actual salary is probably better.
As much as I enjoy humor, I just want to know if someone else observed in their applications.. if so whats the logic?
